PEOPLE managed to access the new court documents filed Wednesday by Patridge in which she states that while the court has issued a restraining order against her estranged husband, he refuses to move out of her “real property” as the order does not mention anything to that effect.
Here’s what she said verbatim in the new court document.
“On September 18, 2017, this court granted me a temporary restraining order, including orders that Respondent stay at least 100 yards away from my home, work, vehicle, etc. However, the court did not grant an order Respondent move out of my real property.”
According to the Hills star, she purchased the property in question before her marriage to Bohan. Furthermore, she says that her prenuptial clearly states that the house is her “separate property” and that Bohan “shall not acquire any interest in my real or personal property.”
She goes on to say that she has been staying with her parents ever since she fled her home with daughter Kirra while Bohan continues to unlawfully occupy her property holding all her personal possessions.
“I fled my home with our daughter [on Sept. 6], and have been staying with my parents because of [Bohan’s] abusive behavior,” Patridge says in her restraining order modification request. “[Bohan] is holding all of my personal possessions and my home hostage, knowing he has no claim whatsoever to this property.”
“Accompanied by my father, Mark Patridge, I attempted to gain access to my home on Sept. 19 … When we arrived at my house, I was shocked that [Bohan] had installed cameras throughout the house. My brother was also present. The restraining orders prohibit [Bohan] from keeping me under surveillance.”
However, Bohan has contested her claims in his response to the temporary restraining order alleging harassment at the hands of Patridge and her family members accusing them of “trying to instigate a fight.”
He claims that “on Sept. 19, [Patridge] and her family members showed up at the residence, literally banging in the house through the garage door after I texted stay out in the front of the house … and started harassing me.”
He also refutes Patridge’s snooping allegation against him saying that there are only two cameras installed at the property and not five as claimed by Patridge adding that the reality TV star was fully aware of the nanny cam and the camera covering the front of the house.
He further says that the court order restrains him from staying away from her parents’ home, where Patridge is currently staying, and not the family home. He, therefore, refuses to vacate the family residence in spite of Patridge’s name on the title deed of the property.
“[Patridge] is ignoring the fact that the temporary restraining order is a stay-away from her current home, which is at her parent’s home, not the family residence.”
Bohan further claims that he is the one who has been paying for maintenance and utilities and that he is being denied an alternative time to visit Kirra accusing Patridge’s attorney of “hijacking” his visitation rights by intentionally scheduling the court hearing to coincide with the day and time of his scheduled visit.
